The Islamabad High Court (IHC) has suspended the implementation of a decision ordering a private airline, Airblue, to pay around Rs 5.04 billion. in compensation to the families of the victims of the 2010 private plane crash in the federal capital.
IHC Justice Arbab Muhammad Tahir was hearing the appeal filed by the airline against the order of a district and sessions court in Islamabad.
The IHC judge, after hearing the preliminary arguments, issued a stay order on the airline’s petition and served notices on the parties directing them to file their replies by April 23.
Airblue’s lawyer, Hasan Mandviwalla, argued that the lower courts had imposed liability beyond the statutory limits without any finding of intentional wrongdoing.
Mandviwalla further noted that the Carriage by Air Act 1934, which was in force at the time of the crash, imposes an even lower threshold of liability.
