The provincial Supreme Court of Khyber Pakhtunkhwa (KP) has accepted a petition seeking compensation for a group of people killed during an air strike by alleged hiding place for terrorists in KP’s Khyber District in 2013.
According to the petition, fighter jets bombed on January 31, 2013 residence of the petitioner, Ghazi Jan, in the Kuki Khel area of the former Khyber agency.
The attack resulted in the death of five members of his family including his mother, wife, son and two daughters. Jan and another person also inflicted injuries while four rooms in his house were completely destroyed.
Following the incident, an application was submitted by Madokhel Jirga to the then assistant political agent of the Khyber Agency, which forwarded the same to the political agent for the allocation of compensation.
After a request, the political agent ordered compensation on RS3 LACs per Deceased. The petitioner claimed that RS1 LAC was paid for each wound but claimed that no compensation was allocated for the broken house.
As the petitioner was not satisfied with the compensation amount, the petitioner filed a written petition, which Peshawar High Court (PHC) disposed of on April 19, 2022, when it ordered the KP Chief Secretary to investigate the case considering the previous judgments adopted in WP No.59-P/2016 and WP No.3562- P/2017.
Since the case could not be decided as stated by this court, the bull the contractor for the filing of contempt petition. After hearing arguments from both parties, Justice allowed Fazal Subhan of the PHC petition and instructed the Ministry of Defense, Safron and the Financial Department to arrange payment of compensation to the petitioner at the earliest with a rate of RS10,94,816 per year. Deceased.
However, it ordered that RS3,00,000 per The deceased previously paid to the petitioner of the political authorities of the former Khyber agency is deducted from the amount.
