Islamabad:
Islamabad High Court Bar Association (IHCBA) has also approached the Apex Court against a new seniority list issued by the former IHC chief, Aamer Farooq, after transferring three new judges to the capital’s Supreme Court earlier this month.
Constitutional Constitutional Petition, filed in accordance with Article 184 (2). The judges cannot be transferred from one Supreme Court to another without the public interest.
The petition requests that the judges transferred to other high courts must be recognized as judges before these respective courts until they take a new oath.
It also seeks to cancel the appointment of IHC functioning Chief Justice, Sardar Muhammad Sarfraz Dogar; To count seniority only after the new judges take their oaths and to direct the IHC registrar to issue a revised seniority list.
Law of Law On February 1, a review of the transfer of Justice Dogar, Justice Khadim Hussain Somro and Justice Muhammad Asif – respected from Lahore High Court, Sindh High Court and Balochistan High Court – to IHC.
Later, IHC the former Chief Justice Aamer Farooq issued a new seniority list, where Justice Dogar appeared as senior puisne. Five IHC judges, including former senior Puisne -Judge Mohsin Akhtar Kayani, filed representations against the move that Justice Farooq rejected.
The judges later approached the Supreme Court against the new seniority list.
