Blake Lively has dropped demands related to the application of emotional distress against Justin Baldoni.
In her new legal archives, Lively requested Tuesday to retire and reject her allegations of intentional application of emotional distress and negligent application of emotional distress.
The move comes in response to a letter filed by Baldoni’s letter Kevin Fritz, requesting Judge Lewis J. Liman in the US District Court of Court in the Southern District of New York on “An order that convinces Blake Lively to identify her medical and mental health providers.”
The order would oblige lively to sign a HIPAA release for access to therapy notes and relevant medical information.
Lively refusing “to reveal the information and documents needed to disprove her to suffer any emotional distress” and seeks to “maintain the right to archive her again [infliction of emotional distress claims] At an unknown time in this or another court after the discovery window is closed, ”Read her filing.
“Mrs. Lively can not have it both ways,” her legal team said further in the document.
Lively’s lawyers Esra Hudson and Mike Gottlieb also approached the recent step in a statement.
“Once again, this is a routine part of the lawsuit used as a press stunt. We do what legal attorneys do: Preparing our case for trial by streamlining and focusing it; they do what they do: Desperatly seeking another tired round of tabloid coverage,” the lawyers told People Magazine.
The actress “continues to claim emotional distress as part of several other claims in her trial, such as sexual harassment and retaliation, and massive further compensatory damage to all her claims.”
Both cases in Lively v. Wayfarer Studios et al. is scheduled for trial in March 2026.
Baldoni faces accusations of sexual harassment, “unprofessional” behavior on the set and launch of a retaliation of smear campaign. Meanwhile, lively, her husband Ryan Reynolds and their advertising team are counted by Baldoni over defamation and extortion.
