Education Secretary Linda McMahon told California Govin Gavin Newsom Monday that he will hear from Attorney General Pam Bondi after the state turned out to be in violation of title IX.
California Department of Education (CDE) and California Interscholastic Federation (CIF) rejected the US Education Department’s Office for Civil Rights’ (OCR) proposed decision -making agreement after controversy for transking athlete in high school athletics during the school year.

Linda McMahon shared CDE General Counsel Len Garfinkel’s letter to OCR Regional Director Bradley R. Burke Monday.
“The California Department of Education (CDE) received the US Ministry of Education for Civil Rights’ (OCR’s) June 25, 2025, letter to find and proposed decision-making agreement in the above OCR case,” the letter reads.
“CDE is respectfully disagreeing with OCR’s analysis and it will not sign the proposed decision -making agreement.”
McMahon also shared CIF’s response from its general adviser, Diane Marshall-Freeman.
“The California InterScholastic Federation (CIF) Office of the General Adviser for the General California Intercolastic Federation (CIF) receives your letter, dated June 25, 2025, addressed to Dr. Ronald W. Nocetti, CEO of CIF,” Marshall-Freeman wrote. “I am writing in response to your request that cif in form you ‘in writing at noon not, Eastern time, July 7, 2025,’ whether CIF will sign the US Ministry of Education, Office for Civil Rights’ (‘OCR’) proposed decision -making agreement in the above -mentioned case.
“In response to your request, please advise that CIF matches the answer from California’s Education Department (” CDE “), which was submitted to your office earlier today, on July 7, 2025.

McMahon’s message to Newsom was ready.
“California has just rejected our decision -making agreement to follow federal law and keep men out of women’s sports,” she wrote on X. “proves Gov. Newsom’s recognition that ‘it’s a matter of justice’ was empty politically magnificent.

The US Ministry of Education for Civil Rights (OCR) announced late last month that CIF and CDE were in violation of title IX.
The message came weeks after Transgender High School Track and Field -Aatlet AB Hernandez won medals in girls -competitions during California’s state championships. The transient athlete’s participation in the events triggered nationwide indignation, specifically from President Donald Trump, after signing “No men in women’s sports” executive order banning transnry athletes to compete against biological girls and women in sports.

“CDE and CIF will be lifted any guidance that advised local school districts or CIF members to allow male athletes to participate in women’s and girls sports to reflect this title IX avoids state law when the state law is in conflict with title IX.
“CDE requires each recipient and CIF to submit to CDE an annual certification that the recipient and CIF have complied with Title IX. Accordingly, CDE will also propose OCR a monitoring plan to ensure that the recipients fully comply with section IX.”
Newsom’s office responded to the initial message and brush of the Trump administration’s threats to defend California.
Newsom previously talked about transgender participation in girls sports back in March with prominent conservative Charlie Kirk.
“The young man who is winning the state championship in the long leap in female sports should not happen,” Kirk said. “You, as a governor, should go out and say no. Would you do something similar? Would you say that no men in female sports?”
“I think it’s a matter of justice. I totally agree with you about it. It’s a matter of justice – it’s deeply unfair,” Newsom told Kirk. “I don’t fight with the fairness question. I totally agree with you.”
Kirk pressed Newsom about whether he would condemn that athlete from the Jurupa Valley High School after the athlete won another event at the time. Newsom did not directly treat the victory, but said “It’s a matter of justice.”
“So it’s easy to call the unfairness of it,” he said. “There is also humility and grace. … These poor people are more likely to commit suicide, have anxiety and depression. And the way people speak to vulnerable societies is a question that I also have difficulty with.
“So both things I can hold in my hand. How can we solve this problem with the kind of decency that I think you know is inherent in you, but not always expressed about the question?”
Newsom also explained his view at a press conference on April 2 when asked if there should be a allowed to ban men from competing in girls and women’s sports.

“And I am as transparent about this as someone out there, especially in my party, on this, and to the extent that anyone can and do it in a way that is respectful and responsible and could find some kind of balance, then I am open to that discussion. … you are talking about a very small number of people, a very small number of athletes, and my responsibility is to tackle the pressing questions in our time.
“And this, I think, has been colored in and weapons by the right to be 10 times, 100 times greater than it is, and therefore my focus is on a myriad of other questions in this state. And to the extent that someone could find the right balance, I would embrace these conversations and the dignity that hopefully presents itself in this conversation, which means humanity about this conversation, not the policy around this conversation.”
