ISLAMABAD:

Justice Mohsin Akhtar Kayani, the chief puisne judge of the capital’s high court, has noted that it is very difficult to prove one’s money trail as former Chief Justice of Pakistan Qazi Faez Isa had also “failed” to do so.

Justice Kayani made this observation on Monday while hearing a petition filed by one Dr Tashfeen Khan against a summons issued by the National Accountability Bureau (NAB) on alleged money laundering.

During the hearing, the petitioner’s counsel argued that his client had transferred his money abroad through legal channels and that they could prove the money trail of this transaction.

The judge noted that he would accept the petitioner’s request if he proved the money trail.

“It is really difficult to prove one’s money trail. Even Justice Qazi Faez Isa could not prove his money trail,” the judge added while adjourning the case till January 30.

In 2019, the PTI-led government filed a case against Justice Isa, then a senior SC judge, accusing him of misconduct. The reference maintained that Justice Isa had failed to mention the foreign assets of his family members in his statement of assets.

On 19 June 2020, a 19-judge full bench of the Supreme Court quashed the presidential reference.

A money trail refers to the sequence of transactions or movement of money, often used to trace financial activities and determine the origin, flow and final destination of funds. It involves documenting how money changes hands or is transferred through different accounts, entities or individuals.
