Former San Jose State University Women’s Volleyball Assistant coach Melissa Batie-Smoosis has brought a case against the California State University (CSU) system. SJSU is one of 23 California-based schools that are part of the CSU system.

Batie-Smoose’s contract was not renewed when it expired in February after he was suspended from the team in the middle of the season for submitting a title IX complaint about the program’s handling of a transking athlete on his team and a female player who opposed the trans-athlete.

Now Batie-Smoose claims wrongful termination and claims that she “suffered and continues to suffer from losing wages, loss of professional reputation and opportunity, emotional distress and other damage.”

“The defendant’s actions were intentional, intentional and/or taken with reckless ignoring the applicant’s federally protected rights,” the trial states.

“Other coaches who did not oppose the inclusion of a biological man on the women’s volleyball team, or who did not speak to the rights of female athletes, were not exposed to suspension, termination or discriminatory acts as it was plaintiff.”

A spokesperson from San Jose State University responded to the trial.

“We are aware of the filing and have no further comments due to pending litigation,” spokesman Pakinomist said Digital.

Batie-Smoose’s title IX complaint against the school, which she filed at the end of October last year, first brought about accusations that the transsexual athlete, Blaire Fleming, conspired with an opponent’s player to get teammate Brooke Slusser connected to the face during a game.

Slusser previously joined a lawsuit against NCAA and filed another against the Mountain West conference with reference to her experience of being made to share changing spaces and hotel rooms with Fleming without being told that Fleming’s birth sex.

Batie smoosis was then suspended at the beginning of November, while the allegations against Fleming received an investigation from the mountain west of the situation.

Mountain West’s investigation provided that there could not be sufficient evidence, but Pakinomist Digital reported later that the law firm, which was hired to conduct the investigation, Willkie Farr & Gallagher (WFG), is the same company representing the mountain West against Slusser’s lawsuit, which also contains the claims against flaming of conspiring to have a sludge. “People recognize me in society, and I’m in an area that speaks out and talks about fighting for women’s sports, I’m in an area with some crazies, and I definitely think it was a goal of me to speak out,” she said.

Meanwhile, SJSU is undergoing continuous investigation by the US Ministry of Education for its handling of the situation involving Fleming and Slutser.
