IHC order the girl’s polen visit to meet mother

Islamabad:

Islamabad High Court (IHC) on Wednesday ordered a citizen to take his daughter to Poland to meet his mother, in a case involving a custody.

Justice Mohsin Akhtar Kayani issued the order while hearing a petition filed by the girl’s Polish mother, Anna Monica, who is seeking custody and visiting rights for his daughter.

The court also sought items regarding prior attempts to facilitate online meetings between the child and her mother and noted that such contact had been denied.

The petitioner’s lawyer told the court that despite repeated efforts, the father had not arranged any virtual meeting through WhatsApp or other platforms. In response, the father’s lawyer claimed that a trial had already rejected mother’s custody and that the father was limited from travel because of his admission to the list without a fly.

However, Justice Kayani made it clear that the child should be allowed to meet his mother and emphasized the court’s intention to deal with the case impartially.

He observed that children are the real victims of parents’ disputes and reiterated that the court cannot solve personal affairs between spouses, only ensures that the child’s rights are protected.

The judge noted that if the girl spends time with her mother, she would eventually adapt to the situation.

He instructed the Federal Investigation Agency (FIA) not to prevent the father’s journey to Poland and emphasized that although the father is free to go where he wants, he must not mislead the court.

The consultation was postponed until September.
