Independent Note release attached to SC -Authorization

The Supreme Court has decided that the notes on the dissence of a judge in any question would only be published after the approval of the head of that bench, sources of the Express Pakinomist told Monday.

According to the sources, the disagreement is written by Justice Ayesha Malik and Justice Aqeel Abbasi – which states petitions that challenge the Supreme Court’s 12 July 2024, the verdict on the award of reserved seats in the National Assembly and the Provincial Assembly – only given after approval from the head of the Constitution of the Constitution Bench (CB).

In the past, if a judge disseminated at the beginning of a case and left the bench, the disagreement was previously published on the Supreme Court’s website. This was a common practice under the previous chief law.

According to the procedure, if a judge wrote a disagreement note, the IT Department of Supreme Court would upload it on the site immediately. This practice was also followed during the tenure of the former Chief Justice Umar Ata Bandial.

Recently, Justice Malik and Justice Abbasi had rejected the notification appeals against the Apex Court’s reserved seats decision on the first consultation of the case for CB. The two judges sent a common dissent note for its uploading on the Supreme Court website.

In a letter written to Chief Justice Yahya Afridi, however, justice said Malik said the dissence of the two judges was sent to the IT department on the Supreme Court’s site, but it had not been uploaded. An 11 member CB led by Justice Khan will hear the case Tuesday (today).
