Khokhar challenges 26. Amendments objection

Tehreek-E-Tahaffuz Ayeen-E-Pakistan (TTAP) Senior Vice President Mustafa Nawaz Khokhar on Thursday filed a chamber appeal that challenged the Supreme Court registrar office’s objections to petitions against the 26th constitutional change.

The 26th Constitutional amendment adopted on October 21, 2024, limited the Supreme Court’s Suo Motu Jurisdiction and transferred the authority to appoint Chief Justice of Pakistan (CJP) to a special parliamentary committee. According to the new event, the committee can select CJP from from the three most older judges at the pointed right instead of automatically raising the senior most.

At present, the Supreme Court handles several petitions seeking the formation of a full court to consider the question, rather than the constitutional bench (CB), which is laid down in accordance with the 26th amendment. CB is scheduled to continue to hear the original appeals on October 7th.

In his appeal, Khokhar has requested the Apex Court to declare the September 19th of the Registrar Office, arguing that cases relating to constitutional changes could only be heard by a full court, not a constitutional bench.

He noted that orders from Justice Mansoor Ali Shah and Justice Munib Akhtar, referring the case to a full court, were still intact. The appeal further claimed that the registrar office’s steps to return the petitioners violated the decisions of the Supreme Court and constituted “to close doors of justice”.
