EXCLUSIVE: San Jose State University’s Transgender Volleyball Player -Controvers repeated last week. Pakinomist Digital reported that the Mountain West conference hired the same law firm to investigate Trans Athlete’s Mission Reliefs that the conference used to defend the athlete’s justification for the conference tournament in court.

“It is scandalous, wrong and misleading that MWC hired the same law firm to both conduct an allegedly independent investigation of his member SJSU and defend the MWC in a federal trial of MWC’s joint behavior and actions with SJSU,” Bock said in a statement delivered to Pakinomist Digital.

Pakinomist Digital reported on June 24 that Mountain West hired the company Willkie Farr & Gallagher (WFG) to investigate accusations against Blaire Fleming of conspiracy with an opponent to have teammate Brooke slushes injured during a 3rd October game.

Mountain West hired the company to handle the investigation in the same month that the same company represented the conference to protect Fleming’s eligibility in a request for preliminary injunction to have the Trans -Aatle disqualified from women’s competition and the conference tournament.

The study closed after only three days and documents obtained by Pakinomist Digital showed that investigators repeatedly incorrectly dated the game as the game on October 2nd.

The WFG Attorney who led the investigation into allegations against Fleming, Tim Heafhy, later offered the school’s legal adviser to help it navigate a federal title IX survey in the same situation as seen in public items obtained by Pakinomist Digital. The offer was rejected.

Bock said the revelation “amazed” him.

“I was amazed to learn that WFG represented MWC against Brooke Slusser’s trial at the same time, another lawyer from this company allegedly investigated the attempt to harm Brooke, and whether SJSU and MWC adequately investigated these facts,” Bock’s statement continued.

“The hiring of WFG to perform such conflicted and mutually exclusive roles suggests that Commissioner Nevarez and MWC had no interest in discovering the truth. Instead, MWC has long been focused solely on promoting SJSU’s interests and pushing the narrative that men should be allowed in women’s college -sports creatures and shower and shower and competition against women in college.”

Bock called for the US education department to investigate the situation.

Bock leads Slusser’s lawsuit against SJSU and Mountain West and also leads a major trial against NCAA led by the former college swimmer and current “outkick” host Riley Gaines.

Bock called previous conference’s investigation into Fleming’s claims “Inadequate, and anything but thoroughly” in a statement from November 17 and called for the evidence to be revealed.

No evidence was ever revealed by the conference as Fleming continued to end the season, earn all-conference hands and even led SJSU all the way to Mountain West Championship Game. The Trans athlete traveled and room with female teammates for Las Vegas in the last week of November for the conference tournament.

After leading after the investigation that cleared Fleming’s charges in November, Heafhy returned to San Jose State’s legal adviser Dustin May on February 6 and offered to help navigate a federal probe. President Donald Trump just signed an executive order to try to enforce this mandate only weeks into his presidency on February 5th. And only one day after launching Trump’s education department one Study of SJSU over the fleming situation.

May rejected Heafhy’s offer on February 18, but Heafhy responded the next day and wrote, “Let me know if we can in any way help in any way about this or other problems.”

None of WFG’s lawyers have been accused of violating any applicable rules for professional behavior.

Pakinomist Digital has reached Mountain West, San Jose State and Willkie Farr & Gallagher for a response to Bock’s statement.

Doe’s study of SJSUS handling the situation involving Fleming is in progress.

The White House made a statement relating to the recent revelations to Pakinomist Digital.

“President Trump is obliged to end the dangerous and unreasonable participation of men in women’s sports and restore common sense. President Trump will continue to speak and take immediate action against schools that jeopardize the security of female athletes,” spokesman for the White House Liz Huston said.

Bock’s office submitted an answer to a resolution to reject the case on June 23. The response mentioned the allegations against Fleming about mismatch.

WFG and Mountain West’s legal struggle to keep the trans athlete in the women’s tournament were successful when federal judge Kato Crews, who was appointed by President Joe Biden in January 2024, steered in favor of Fleming’s eligibility on November 25.

Two days later, after a failed appeal from the plaintiffs, the company announced an online press release announcing the legal victory to keep Fleming eligible to play.

But that web page has since been deleted. Pakinomist Digital asked why the site no longer exists, but Willkie Farr & Gallagher did not respond to the study.

Archived data Shows the original press release stating, “Willkie secured a high-profile victory for Collegiate Athletic Conference Mountain West Conference in a suit brought by Members of San Jose State University’s Women’s Volleyball Team and other Mountain West teams that played against SJSU.”

Pakinomist Digital previously reached Mountain West, Willkie Farr & Gallagher, San Jose State University and its main volley coach Todd Kress regarding the previous findings. No answer has been given by these parties.

May’s office initially responded to Pakinomist Digital’s request for comment after delivering public items requesting a list of questions and background information before they speak. Pakinomist Digital did not provide the information or list of comments and requested a virtual or telephone interview.

May’s office then responded with the statement, “any speculation that the company or lawyer mentioned in your investigation represented SJSU, or CSU is unfounded.” Pakinomist Digital had not asked that question or any other provision, only a request for interview, at that time.

Pakinomist Digital later followed up with May’s Office requesting an interview to tackle other questions and fulfilled his office’s request to provide background information about what would be discussed.

May’s office replied and said, “He will not be available,” and has not responded to request for further comment.
