Miley Cyrus bid for dismissal of ‘flowers’ trial challenged

Miley Cyrus is bound to meet last year’s trial of similarities between her hit -sang Flowers and Bruno Mars’ Ballad When I Was Your Man.

A judge rejected Cyrus’ request to dismiss a trial from Tempo Music Investments on Tuesday and noted a misunderstanding about Cyrus and her legal team part.

For those who are not daring, Flowers Hitmaker was sued in September 2024 by Tempo Music Investments, which owns a share of Copyright for Mars’ song after purchasing the catalog rights from the song co -author Philip Lawrence.

The company claimed in its archiving that Cyrus ‘2023 hit song “duplicates several melodic, harmonious and lyrical elements” and that there was “unauthorized reproduction, distribution and exploitation” of Mars’ 2013 track When I Was Your Man.

Flowers‘Songwriters Gregory Hein and Michael Pollack were included among several defendants along with Sony Music Publishing and Apple. Mars, 39, however, was not named in the trial.

Tempom music investments have sought an indefinite amount of damage besides asking that the defendant stopped stopping to reproduce, distribute or publicly Flowers.

Cyrus denied the claims in November 2024 and filed to reject the trial and said that only owners of the exclusive rights can take litigation over it.

In the recent decision, the court said Cyrus and her lawyers had a “misunderstanding” of the legal precedent about what “exclusive” means.

“Ownership of ‘exclusive rights’ should not be in conflict with ‘exclusive ownership’ of rights. The ‘exclusive rights’ are what is collective by co -owners,” says the order per. People Magazine.

“Lawrence’s interest was a CO ownership interest in copyright,” the judge elaborated.

“By transferring all this interest, Tempo now enters Lawrence’s shoes and co -owns the exclusive copyright rights,” the archiving read.

In a statement, Tempo Music Investments’ lawyer said they were “enthusiastic” but not “surprised” by the decision.

“Our client is looking forward to having this case continued to be solved on its benefits and is extremely confident in applying,” said their lawyer Alex Weingarten.
