Minallah issues dissent in contempt case

Supreme Court Judge At Har MINALLAH has issued a handwritten dissensing note in a case related to the commencement of the contempt procedure against the SC additional Adjuster Court Nazar Abbas.

The judge was part of the six-member larger bench that took the extra justice secretary’s intra-court appeal against a display of show cause issued by a division bench.

The petitioner had later filed an application requesting permission to withdraw the appeal submitted in accordance with section 19 of the contempt of the Court’s Regulation, 2003.

On January 27, two members of the bench – Justice Shahid Waheed and Justice Minallah rejected the appeal due to being withdrawn. They had noticed that when the original bench had discharged the contempt notification, the continuation of the appeal was no longer necessary or relevant.

In his note, Justice Minallah joined the statement from Justice Shahid Waheed. He noted that the intended appeal had become infuctive when the message had been discharged.

“This bench was composed under disdain for Legal order, 2003 read with Article 204 of the Constitution of the Islamic Republic of Pakistan, 1973.

“There is no other work pending before this bench. With the printing of the intended message, therefore, it is no longer rejected that the appeal is therefore rejected,” he added.
