Oregon Trans Athlete Controversy: Education Dept launches probe to Portland Schools

The US Ministry of Education for Civil Rights has opened a title IX study of Portland Public Schools for allowing a transidentifying male athlete to compete in women’s sports, Outkick has learned.

As Outkick previously reported, “Ada” Gallagher is a biological man who won a high school championship in Track & Field last year. Gallagher has continued to compete in girls’ division, despite President Donald Trump signing an executive order to prevent men from competing in girls and women’s sports.

The department sent a letter to Kimberlee Armstrong, Superintendent of Portland Public Schools (District) that informed her that the investigation is now open.

“These accusations include giving a male course studio the opportunity to compete in a girls ‘interscholastic freedom on March 19, 2025 and allow the male athlete to use girls’ dressing room while female athletes changed,” OCR said in a press release.

“OCR also sent a letter notified the Oregon School Activity Association (OSAA), the governing body of Portland Interscholastic League that it opened a corrected investigation into its “Gender IDEMENTITY PARTICIPATION” Policy that seems to violate title IX. ”

Last week, the Oregon Department of Education released new guidelines on sex -based sports participation.

“Non -binary, intersex, gender fluid, two spirit and other students who do not consistently identify with the gender -binary gender cannot be prohibited from playing on the athletic teams of neither gender, in accordance with Oregon Nondiscrimination Law,” the guidelines said.

There is also a section that relates to required uniforms where schools are forced to “develop any athletic uniform policy, taking into account the needs of gender -expanding students.”

Outkick recently spoke with an Oregon female high school athlete who said she would see the federal government getting involved to prevent trans athletes from stealing victories, prices and spots on girls’ teams from women.

“It’s just frustrating that nothing has changed. But I would very much and I know that other women would [as well]Appreciate seeing Oregon being examined for this because I feel like it is so obvious that this is happening and it is so obvious that it is wrong, “Lilian Hammond told Outkick.

Well, Hammond gets his wish as the Department of Education – which has already opened studies in several other states, including Maine, California, Minnesota and Washington – is now investigating Oregon.

“I am very pleased that this gets the attention it deserves,” Hammond said in a text message to outkick after learning about the investigation.

“We do not allow Portland Public School’s District or any other education unit that receives federal means to trample on the anti -discrimination protection that women and girls are guaranteed under the law,” said Craig Trainor, acting assistant secretary of civil rights.

“President Trump and Secretary McMahon have been steadfast in their commitment to protect the rights of women and girls. OCR will use all legal means to ensure that no female athlete is denied equal athletic opportunities or is deprived of her rightful recognition.”

Outkick reached out to Kimberlee Armstrong and Osaa about the investigation. None of them could be reached immediately for comment.

While Oregon, like Maine, has claimed that their state law allows athletes to compete with and against athletes who match their gender identity – rather than their biological gender – has OCR repeatedly made it clear that federal mandates are replacing the state law.

News about the OCR study came the same day as World Athletics, the global governing body of Track & Field, announced that it will perform biological sex tests on female athletes to keep men out of the women’s category.
