The Supreme Court in Pakistan reintroduced on Wednesday the Pakistan Army Act in its original form and overturned its October 23, 2023 resolution, which had declared certain provisions of the law untreated.
In a majority of 5-2 decisions, the Pointed Court maintained the appeals filed by the Ministry of Defense and other, recovered clauses that were previously down, including section 2 (2). 1 (d) (i), 2 (1) (d) (II) and 59 (4) of the Army Act.
Justices Aminuddin Khan, Muhammad Ali Mazhar, Musarrat Hilali, Hasan Azhar Rizvi and Shahid Waheed supported the verdict, while judges Jamal Khan Mandokhail and Naeem Akhtar Afghan dissented from the verdict.
The majority of the verdict has called on parliament to make the necessary changes to the Pakistan Army Act within 45 days to give independent appeal to military courts convicted in High Court.
