‘SC must overturn constitutional order’

Islamabad:

Justice Aminuddin Khan has observed that the pointed right is bound by the constitution and that it can revoke any constitutional judgment.

Justice Khan made this remark on Thursday while leading an 11-member constitutional bench (CB) from the Supreme Court, heard petitions filed against SC’s judge from July 2024 in the case for reserved seats.

On July 12, 2024, a full bench of the pointed right through a majority of 8 to 5 PTI as a parliamentary party resurfaced, noting that 39 of the legislators who had submitted certificates for their association with PTI with their nomination papers were already PTI legislators.

SC stated that the remaining 41 legislators who had not submitted the attachment certificates at the time of the nomination papers could do so within a period of 15 days. The government had later submitted a review of petitions against the verdict.

During the hearing on Thursday, justice Muhammad Ali Mazhar questioned whether the constitution had a mandate for reserved seats to not remain unemployed. The lawyer of an appointment Salman Akram Raja replied that the court had already declared that these seats cannot be left.

Justice Jamal Khan Mandokhail asked what basic rights had been violated by not awarding reserved seats to PTI, while Justice Naeem Akhtar Afghan asked if the court could fill a political vacuum on his own initiative. The court resumes the hearing of the case today.
