SC to hear pleas for review of reserved seats decision

A 13-member constitutional bench (CB) from the Supreme Court admitted to having heard the petitions against Apex Court’s decision to award reserved seats in the congregations to Pakistan Tehreek-E-Insaf (PTI), which would be taken up by an 11 member CB Wednesday (today).

During a hearing on Tuesday, the two members of the bench, Justice Ayesha Malik and Justice Aqeel ABBASI, rejected the petitions for the review as declining. Later, a new causal list was issued that said both judges would not be part of the bench for further consultation of the petitions.

Last year, the Supreme Court gave up that PTI would get the reserved seats in the National Assembly and the provincial assemblies according to its strength in these houses. Pakistan Muslim League-Nawaz (PML-N), Pakistan Peoples Party (PPP) and the Election Commission in Pakistan (ECP) have sought review of the decision.

The petitions were heard by the 13-member bench, led by Justice Aminuddin Khan. During the consultation, the judges raised questions regarding the non-implementation of the Supreme Court’s original decision, which was made on July 12, 2024.

Haris Azmat, the PML-N lawyer, claimed that the reserved seats had been given to a party who was not even a party to the case. On this justice, Malik noted that this point had been answered in the verdict. She then asked the lawyer to apply the court to the basis of the petition.

Justice Malik said the pointed right -hand decision was made after hearing all the points in detail. She asked the lawyer whether or not the court’s decision was implemented. Justice Abbasi noted that there was a disdain for the court’s petition on non-implementation of the decision.

For a request from Justice Hashim Kakar, ECP lawyer Sikandar Bashir Mohmand told the court that the ECP had partially implemented the decision. At this, Justice Malik noted that the ECP could not choose and choose to complete the court decision.

Later, the court postponed the hearing until Wednesday (today). Bench accepted the petitions for initial consultation with a majority of 11-2 and issued messages to the parties concerned. The bench also issued announcements of contempt for the court’s petition, which was filed against the ECP.

Justice Malik and Justice Abbasi made a disagreement and rejected the petitions as declining during the first hearing. Justice Malik said she rejected the three petitions that were declining and would issue detailed reasons later. Justice Abbasi noted that he agreed with Justice Malik.

Later, a new case list was issued on the Supreme Court website, after which an 11 member CB, led by Justice Aminuddin Khan, would hear the petitions. Justice Malik and Justice Abbasi were not included in the bench.

However, Kanwal Shauzab’s petition to initiate disdain for litigation against ECP for non-implementation of the judicial decision was not planned for consultation on the new causal list. On the previous causal list, this petition was included for consultation on Wednesday.
