Islamabad:
A sister of Baloch rights activist Dr. Mahrang Baloch has approached the Supreme Court against an order from Balochistan High Court (BHC) in his sister’s withholding case.
A division bench of BHC on April 15 rejected Dr. Mahrang’s petition against her detention during the maintenance of the Public Order Regulation (MPO), 1960, stating that an alternative means was available to the activist in the form of a representation.
The bench had also converted the petition to a representation and instructed its office to present it before the competent authority constituted for the purpose of deciding representations under MPO.
The petitioner, Nadia Baloch, claimed that the BHC made a mistake by stating that a petition could only be filed before a court after exhausting the possibility of submitting a representation.
The petition claimed that High Court in his written jurisdiction is competent to intervene and directly provide relief to an appointment by determining the legality of an MPO order without the need for the detained person who makes a representation.
It said BHC did not consider Dr. Mahrang’s right to submit Habea’s Corpus Petition. “[This is her] High prerogative right and a constitutional remedy for all questions if they are illegal inclusion, “the petition said.
