EXCLUSIVE: Rep. Kevin Kiley, R-California, responded on Monday after a Pakinomist Digital report that the Mountain West conference hired the same law firm to investigate the transient athlete Brooke Fleming’s accusations of mismatch that the conference used to defend the athlete’s justification for the conference tournament in court.
Kiley had been obvious to transking athletes who competed against girls and women in sports and was contrary to California’s Government Gavin Newsom when the Ministry of Justice filed a lawsuit against the state of alleged violations of title IX.

“The absurdity and unfairness of forcing young women and girls to compete against men also pose obvious security risks,” Kiley said in a statement to Pakinomist Digital. “The Revelations from Pakinomist Digital are very disturbing, but unfortunately not surprising: the same institutions that willingly expose student athletes to the risk of physical injury fails to respond adequately when these damage is materialized.
“Fortunately, the tide has resolutely facing the backwards politicians and organizations that have defied common sense and biological reality in their attempts to undermine severely won civil rights protection for female athletes.”
Former San Jose State Women’s Volleyball player Brooke Slusser was the apparent goal of an alleged plan of Fleming and a Colorado State player to get slushes added to the face during a 3rd October game. Slusses were never spiked in the face during this game. Fleming had 10 errors when SJSU lost against Colorado State in straight sets.
Pakinomist Digital earlier reported that Mountain West hired the company Willkie Farr & Gallagher (WFG) to investigate the allegations.
Mountain West hired the company to handle the investigation in the same month that the same company represented the conference to protect Fleming’s eligibility in a request for preliminary injunction to have the Trans -Aatle disqualified from women’s competition and the conference tournament.
The study was closed after three days when Fleming was cleared of inappropriate. But no evidence was ever revealed by the conference as Fleming continued to end the season, earn all-conference hands and even led SJSU all the way to Mountain West Championship Game.

The WFG Attorney who led the investigation into allegations against Fleming, Tim Heafhy, later offered the school’s legal adviser to help it navigate a federal title IX survey in the same situation as seen in public items obtained by Pakinomist Digital. The offer was rejected.
None of WFG’s lawyers have been accused of violating any applicable rules for professional behavior.
Pakinomist Digital reached out to the company Wilkie Farr & Gallagher, Mountain West conference and California State University System for a response to Kiley’s statement.
Slusser talked late last month about the recent finds in a performance on Pakinomist Channel’s “America Reports.”
“It is obvious when this was exposed to the public that there is so much bias in this situation, and they are just trying to sweep these things under the blanket and do not have to tackle it when there are obvious problems going on everywhere,” she said.
“They need to be held responsible for using the same law firm and not conducting a thorough investigation because title IX was built to protect women, and they obviously decide to protect the man in this situation when they obviously tried to hurt a female athlete at their school, and they still support this male athlete, and it’s just wrong everywhere.
Slusser ultimately hopes that no other female athletes should tackle the same things she experienced.

“The goal is to never have to let another female athlete go through what I did. The sport was ruined for me my senior season,” she said. “So the goal is to give back to the young girls who had the same dream that I did, but to be able to love it all the time.”
