Islamabad: Some judges in the Supreme Court are reportedly considering stepping down from the office, but not until their service period meets the threshold required for a lifelong pension and post -pension benefits The news.
According to insiders, the judge in question is carefully to see the calendar to ensure that their resignation comes only after completing the at least five -year service period, which during a recent Supreme Court’s decision is necessary for a Supreme Court judge to qualify for pension and other privileges after retirement.
The Supreme Court has previously stated that a Supreme Court judge will only be eligible for pension and related benefits after earning at least five years on the bench. Without ending this minimum period, a judge’s resignation would mean the forfeiture of such rights.
Sources who are familiar with the development said that some judges considering early retirement have heard senior officials in the legal administration to investigate whether there is any precedent where a judge was pensioned despite earning less than five years.
They were allegedly informed of such a case, but were also told that it does not apply to their situation. The case involved a judge who had spent a long career in the district’s judiciary before he was raised to High Court. Due to his cumulative service in the judicial system, he was given permission for benefits after retirement despite not having completed five years on the High Court bench.
“Officials made it clear that such a precedent would not cover judges directly named High Court from the bar or other sources without prior court service,” a legal source revealed.
The development is in the midst of increasing speculation about possible resignation in the overall court. Such speculation began to make rounds after the controversial 26th constitutional amendment. While no judge has formally offered their resignation so far, Insiders believe that a few can go down in the coming months, especially those approaching the five -year brand.
