Supreme Court looks at seniority under Article 200

Islamabad:

The Supreme Court postponed Wednesday until Thursday (today) the consultation of Islamabad High Court (IHC) Judge Transfer Case.

A five-member constitutional bench of the peak court, led by justice Muhammad Ali Mazhar, president of the hearing.

During the procedure, the Attorney General of Punjab advanced his arguments and stated that West Pakistan was made a single entity in 1955 through Pakistan Governor’s general order.

As a result, all courts on the Supreme Court were consolidated into one, and a seniority list was drawn up based on the judges’ appointment dates.

However, Justice Naeem Akhtar noted that the situation in the present case was different as there was no legal formation or dissolution in connection with the transfer of judges to IHC.

In response, the Attorney General clarified that his point was only to illustrate that the judges’ previous service and transfers had historically been accepted.

Justiceafhan noted that the central question of the case is whether the judge’s transfer should be considered permanent or temporary under Article 200 of the Constitution.

He further asked why a judge ranked 15. On the seniority list was transferred, while 14 judges senior for him were overlooked.
