On Thursday, the Supreme Court decided to review state prohibition on transient athletes participating in public school sports.

Oral arguments are likely to be heard later in the fall about two cases in Idaho and West Virginia. Both cases are focused on state laws that prevent biological men from competing for girls’ sports teams.

“It’s a fantastic day that female athletes in West Virginia get their voices heard,” West Virginia Attorney General John McCuskey said in a statement. “The population of West Virginia knows it is unfair to let male athletes compete against women; that is why we adopted this common law that preserves women’s sports for women.”

“We are convinced that the Supreme Court maintains Save Women’s Sports Act because it complies with the US constitution and complies with section IX,” McCuskey said. “And most importantly, it protects women and girls by making sure the game field is safe and fair.”
