Two-judge bench to hear cases while the appeal of the court decision is heard by at least three judges

The Federal Constitutional Court has decided to adopt the Supreme Court Rules 2025 for the practice and procedure of the court. A meeting chaired by Chief Justice Aminuddin Khan took the decision, Express Pakinomist learned.
The full court ruled that cases in the FCC will be heard by a bench of at least two judges, while cases against the decision of a two-judge bench will be heard by a bench of at least three judges.
Attorneys from the Supreme Court will be eligible to appear before the FCC, the meeting also decided. The Solicitor General and Solicitors General of all four provinces have been informed of the decisions.
The adoption of the Supreme Court rules clarifies how the newly formed FCC will structure its proceedings. The rules, drawn up by a committee formed by Chief Justice Yahya Afridi, were updated earlier this month.
The committee discussed with the Bar Council of Pakistan and the Supreme Court Bar Association to modernize the 1980 rules and presented the final draft to the full court. The 2025 rules include 60 new provisions, while five outdated provisions were deleted. The new set of guidelines aims to modernize and digitize the judicial system, bringing procedural clarity to the judicial system according to the Supreme Court.
