Islamabad:
A constitutional bench (CB) from the Supreme Court on Tuesday noted that it had received answers from all the respondents in a case relating to the transfer of judges to Islamabad High Court (IHC), while calling on the lawyer for the petitioners not to take too much time to submit his answer.
The five-member CB led by Justice Muhammad Ali Mazhar resumed to hear a number of petitions filed against the transfer of three judges from three different provincial high courts to IHC and the subsequent updating of the court’s Judge’s List of Demand.
Law of Law On February 1, a review of the transfer of justice Sardar Muhammad Sarfraz Dogar, Justice Khadim Hussain Somro and Justice Muhammad Asif – respected from Lahore High Court, Sindh High Court and Balochistan High Court – to IHC.
After this transfer, IHC issued a new seniority list that ranked Justice Dogar as the Senior Puisne judge. Five IHC judges later submitted representations against Justice Dogar.
However, the then IHC High Court, Aamer Farooq rejected these representations. After raising Justice Farooq to the Supreme Court, Justice Dogar was also increased as IHC functioning Chief Justice.
The IHC judges, PTI founder Imran Khan, and four different bar associations were among the seven petries that challenged Justice Aamer Farooq’s order in the Supreme Court.
During the hearing on Tuesday, Justice Mazhar’s lawyer for one of the petitioners – Munir A Malik – told the court that the court had received answers from the respondents. He asked Malik if he should present a response to the answers.
Malik replied that he would submit a written response. When the court asked him how long he needed to present his answer, he sought time for the next Thursday.
Justice Mazhar asked him why he needed so much time. He said many lawyers should present their arguments.
