Officials said in April that Brett Gardner’s 14-year-old son, Miller, was caused by carbon monoxide, but the authorities are still investigating whether it was a murder.

The Gardner family announced Miller’s death on March 23, two days after he was dead. Officials issued the cause of death on April 3, after examining both food poisoning and suffocation.

However, according to ESPN, a spokesman for the Costa Rica prosecutor who handles the case, the case stays under investigation, and prosecutors still decide whether the death will be a murder.

“The purpose of the investigation is precisely to determine whether we are dealing with a possible murder or not. For this reason it is not possible at this time to confirm or rule out that a crime has been committed,” the spokesman said.

Miller was tested for carboxyhemoglobin, a compound generated when carbon monoxide binds to hemoglobin in the blood. The test showed a saturation level of 64%. It is considered deadly when carboxyhemoglobin saturation exceeds 50%.

The Gardner family stayed at Arenas del Mar Hotel in Manuel Antonio.

Several members of the family got sick during the trip, Gardners announced.

“We have so many questions and so few answers at this time, but we know he died peacefully in his sleep on the morning of Friday, March 21,” the family’s statement reads. “Miller was a beloved son and brother, and we are yet to understand our lives without his contagious smile. He loved football, baseball, golf, hunting, fishing, his family and his friends. He lived life to life every single day.”
