Peshawar High Court (PHC) has rejected a petition submitted by ANP leader Aimal Wali Khan, seeking the formation of a high -powered billing committee and a judicial commission to explore the consequences of the PTI government policy to resettle TTP operators in Khyber Pakhtunkhwa (KP).
In his petition, Senator Aimal had claimed that he was concerned by the resettlement of the TTP members, a described organization, after the end of the international forces from Afghanistan in 2021.
He claimed that KP in general and the leadership of his party in particular carried the brown of terrorist activities carried out by TTP, and yet the PTI government allowed in 2022 resettlement of terrorists in the province as a “goodwill gesture”.
In its order, the court admitted that KP has suffered much of the threat of terrorism in the last few decades.
“Thousands of staff in law enforcement authorities as well as the civilians embraced martyrdom in the terror war in addition to the loss of the economy in billions of dollars. Terrorism and terrorists damaged this country’s reputation hard on the reputation of this country [as well as] the population of this province.
“Many recognized political leaders were targeted in the suicide attacks. It would not be out of context to mention that in the recent past there was hardly a day that went without a suicide blast.”
The court noted that the petitioner has requested the formation of a high -driven commission to reveal what the reasons for the resettlement of the members of the described group.
“The available post, however, suggests that he has not annexed any document that could be found in the violation of any of his fundamental rights guaranteed to him under the Constitution.”
The order said that framing different policies and strategies and then pursuing or enforcing them is the function of the government, and no person can claim as a matter of correcting his admission to the decision -making process.
“No doubt a one -once -one government is consulting private individuals [experts] about fiscal and administrative questions about seeking their proposals, but so far there is a movement to start a certain peace process and conversations with someone about a complicated and sensitive question sufficient to say that neither such a process can be discussed with any person or group of individuals, or he or the group can be taken into confidence or related. “
It said the constitution is based on the basic principle of separation of power, adding that there are mainly three state columns with separate powers.
“Every [pillar] of the state has the power to act on its own sphere of activity. Legislator must prepare laws. Executive is to prepare policies subject to law, implement them and run the administration.
