Kashmiri -Leader Misshal Malik, wife of the prison Hurriyat leader Yasin Malik, has accused India of being involved in terrorism and targeted killings around the world, and claims that diplomatic effort alone will not produce results for Kashmir.
She has called on Pakistan to take Yasin Malik’s case to the International Court of Justice (ICJ), similar to how India had presented Kulbhushan Jadhav case.
Kulbhushan Jadhav, an Indian naval officer, was arrested in March 2016 by Pakistani authorities in Balochistan on accusations of espionage and terrorism. Pakistan then pointed out that the work for India’s intelligence agency, RAW (research and analysis wing) and performed undermining activities to destabilize the country.
In April 2017, a Pakistani Military Court sentenced Jadhav to death, which led to a diplomatic standoff between India and Pakistan. India denied espionage charges and took the case to the International Court of Justice (ICJ) and argued that Pakistan had violated Jadhav’s rights under the Vienna Convention by refusing consular access.
In July 2019, ICJ gave in favor of India and ordered Pakistan to give Jadhav consular access and undergo his death sentence. However, Jadhav remains in Pakistani custody, and diplomatic tensions over his case continue.
Misshal Malik has now drawn parallels between India’s steps to take Jadhav’s case to ICJ and Pakistan’s passivity regarding Yasin Malik and calls for Pakistan to take similar legal steps to fight for Kashmiri leaders imprisoned by India.
In a speech at the Lahore High Court Bar Association, Misshal Malik claimed that her mother was recently poisoned and killed, which highlighted what she called India’s hidden operations and cross -border terrorism.
‘Why can’t Pakistan take Yasin Malik’s case to ICJ?’
Unsham Malik questioned why Pakistan has not taken Yasin Malik’s case to ICJ, especially when India managed to bring the case of the convicted spy Kulbhushan Jadhav before the international court.
“If India can take Kulbhushan Jadhav case for ICJ, why can’t Pakistan take Yasin Malik’s case there?” She asked.
She rejected the idea of negotiations with India and said that the dialogue has no value and will lead to no solution. “There is no advantage in expanding an invitation to interviews to India,” she claimed, stressing that litigation in international courts is now necessary.
Requires stronger political action at Kashmir
However, Malik Malik greeted Pakistan’s army’s Chief’s statement to fight ten wars for Kashmir and called it a positive attitude. However, she emphasized that it is the responsibility of politicians to effectively present the Kashmir question to global leaders.
She urged political leaders to go beyond mere speeches and take concrete actions, including:
- Follow -up of diplomatic initiatives
- Organizing large rallies and protests
- Pushing for international legal interventions
“Kashmiri -leaders are silent”
Misshal Malik also criticized the Indian judiciary and said Kashmiris has never received justice from Indian courts. She claimed that India is engaged in a systematic campaign to eliminate Kashmiri leadership, imprisoning all key leaders for weakening the movement.
“Our entire movement is to be leaderless through a conscious strategy. All our leaders have been thrown into prisons. The world saw how Syed Ali Geelani was martyrated, and yet no one was placed responsible, ”she said.
She urged Pakistan’s legal and diplomatic societies to take crucial steps in international forums to challenge India’s actions in Indian-ly-one-occupied Jammu and Kashmir (IIOJK).
