Yuga Labs Bored Ape Yacht Club $ 9M win against Ryder Ripps overturned, should better prove trademark overrun

The creator of the dull Ape Yacht Club non-funny symbols (NFTs) must better prove that a “satirical” version of these tokens was meant to mislead buyers, a US appeal on Wednesday said, overturning a decision in lower court and sent the case back to the lower court of a new trial.

The US Appeals Court for the Ninth Circuit gave up that a district court that found that Ryder Ripps ‘NFT collection injured Yuga Labs’ trademark NFT’s should be reconsidered, but without weighing whether there was actually trademarked – only what Yuga needed to do a better job to demonstrate that under the law, Court Document.

Ryder Ripps and Jeremy Cah, the duo behind the RR/Bayc NFT collection, had previously claimed that their tokens were intended to be a satirical reaction to the actual Bayc. Yuga Labs defendant in 2022 and claimed that trademark violations and cyber quatting.

A partial brief judgment of a district judge found that Yuga is performing his own brands for his bored Ape Yacht Club NFT collection, and that Ripps’ RR/Bayc NFT collection causes confusion when the images looked the same. Ripps appealed the final decision, which included a fine of over $ 8 million to be paid to Yuga. The Court of Appeal said that while Yuga has priority on the trademark because of being the first to use “The Bored Ape Yacht Club Marks,” it had not proven that Ripps’ NFTs caused confusion.

Nevertheless, Yuga Labs must return to the trial. “Yuga can eventually prevail over these claims, but to do so it has to convince a factfinder during the trial,” the archiving said.
