Justice Kayani sorry institutional collapse

Islamabad High Court (IHC) Senior Puisne -Judge Mohsin Akhtar Kayani has said what happens to the ordinary man who also happens to the judges in the country.

During the consultation of a case related to Capital Development Authority (CDA), justice painted Kayani on Thursday a bleak image of the state of various institutions, including the judiciary.

According to Justice Kayani, no institution did her job properly.

“Tell me about a single institution in Pakistan that has been able to deal with his responsibility. Name an institution that makes the job it was meant to do,” said Justice Kayani.

The judge noted that all the powers of CDA under the law should be transferred to Metropolitan Corporation. He said that the functions currently performed by the CDA board should rightly belong to the local government, which also has authority over each rupie used.

“The Constitution says elected representatives of the people will exercise authority,” he noted, adding that while High Court had handed down four decisions and the Supreme Court, the government still had not allowed local government elections in Islamabad.

Justice Kayani noted that the state of the subordinate courts was serious. “Our very spirit has been lost. Is there anyone who is aware of how 250 million people live?” He asked.

He also said that there are serious issues of governance, as functions intended to be performed by elected representatives are instead carried out by the courts.

“If the law fits someone, they insist that the system must continue; if it does not fit them, the law is set aside. For five years now the choice of LG is not allowed because they do not fit certain quarters,” he said.

Calling the situation “deeply unlucky” said justice Kayani that people could only ask for improvement in the situation. “Everyone has to do their jobs. There are mistakes, but there should be no bad faith,” he added.
