First at Fox: The US Education Department and Department of Health and Human Services have decided that Minnesota training agencies have violated title IX by allowing biological male trans athletes to compete in girls’ sports, Pakinomist Digital has learned.
President Donald Trump’s administration found the Minnesota Department of Education (MDE) and Minnesota State High School League (MSHSL) in violation of title IX after two months long investigation of state policies and a transgender pitcher leading a girls’ softball team to a state championship.
A press release from the education program obtained by Pakinomist Digital quotes the pitcher’s performance in the 2025 season of the recent crash stating “The male pitcher over -labeled female athletes over five consecutive matches, giving up only a deserved race over 35 laps and knocking out 27 female slaughterers.”

The release also quoted cases of trans athletes competing in girls’ alpine skiing, girls’ Nordic skiing, girls’ lacrosse, girls’ track teams and field teams and girls’ volleyball.
“For many years, Minnesota’s political leadership has found itself on the wrong side of justice, common sense and the American people. Now the Minnesota Department of Education and Minnesota State High School League is on the wrong side of title IX by giving men the opportunity to compete in women’s sports,” said Doe Acting Assisting Assisting Secretary for Civil Traint.
“Trump administration does not allow Minnesota or any other state to sacrifice the security, fair treatment and dignity of its female students to satisfy the false idols of radical gender ideology. When an educational program or unit takes federal means, title IX compliance becomes mandatory. And the federal government will hold Minnesota responsibly until it acknowledges this character.”
Doe and DHHS have now given the state and its educational agencies a 10-day deadline to change its policies to comply with section IX and President Donald Trump’s “Keeping Men Out of Women’s Sports” Executive Order.
The conditions of this Agreement are:
- MDE and MSHSL must cancel or revise any guidance that allows men to compete in girls’ sports to comply with title IX and to reflect it to the extent that state law conflicts with title IX, federal law, avoid state law;
- MDE issues a state notice to all federally funded units that operate interscholastic athletic programs that require their strict observance of section IX by separating athletics and intimate facilities based on sex;
- The message requires these entities to adopt biology-based definitions of “male” and “female” and reminds them that failure to comply with section IX places their federal funding at risk;
- MDE and MSHSL will submit updated title IX training, procedure and process material for ED’s OCR and HHS ‘OCR to review and approve and will complete the approved training for MDE and MSHSL staff;
- MDE will restore to female athletes all items and titles that are incorrectly used by male athletes competing in female categories and sending every female apology letter on behalf of the state of Minnesota to allow her educational experience to be destroyed by sex discrimination. MDD requires in writing that MSHSL takes parallel actions; and
- MDD requires that each school and MSHSL submit to an annual certification that they have complied with section IX.
If these conditions are not met, the state agencies will be referred to the Ministry of Justice. DOJ has already brought legal proceedings against Main’s educational agencies and California over the same question about trans athletes in girls’ sports.

Minnesota Attorney General Keith Ellison has already brought his own trial against Trump and DOJ for trying to enforce his policies to protect girls’ sports in Minnesota. Ellison has boasted of “suing them first” regarding the question.
Meanwhile, the situation involving the softball player has already spurred on another trial from three teenage girls who have had to compete against Trans Pitcher. A federal judge rejected the trial earlier this month.
The trial was filed by three anonymous female athletes against Ellison, Minnesota State High School League director Erich Martens, Minnesota Department of Human Rights Commissioner Rebecca Lucero and Minnesota Commissions of Education Willie Jett.
One of the anonymous plaintiffs told Pakinomist digital that the dismissal is “disturbing” and “frustrating.”
“This is so disturbing. I honestly don’t think it’s fair that this is still going on. I really hoped the court would command it to stop immediately, and now it just feels super frustrating, not only for those affected now, but for all the girls it could affect,” she said.
The transsexual athlete, Marissa Rothenberger from Champlin Park High School, led the school to a state championship last year while dominating female opponents.
Rothenberger threw a closed closure that allows only three hits and knocked out six in the championship, closing a race that saw Rothenberger Pitch all 21 laps across three government tournament games and gave only two races. The junior allowed only two races across 35 total laps in the post -season.
One of the applicants former Pakinomist Digital told what it was like to play against Rothenberger.
“Hitting against him is not only a physical challenge, but also a mental. It’s a mental struggle by knowing that he has an advantage in the sport I grew up playing, which made it hard to even hit him,” the player said.
“His ability to get outs and turn the ball is a strong advantage, but as I said, it is also incredibly mentally challenging to know that you compete against someone who has unreasonable benefits that leave you a little or no confidence.
“This question has affected me in ways I had never imagined. It is simply unfair and I hate that nothing is happening to change it. Boys should not be able to take girls’ spots on team just because they are capable of it. I hope more girls affected by this question will face this.”
Now the federal government is stepping up to intervene.
