Issues guidance in cases of private persons performing official duties in Islamabad patwar circles

Islamabad High Court (IHC) has ordered Islamabad administration to issue targeted advertisement for patwari posts. Criticizing the administration, Justice Mohsin Akhtar Kayani said, “You have now even created a constitutional court, but the work is still not being done,” he said.

Justice Kayani added: “Try appointing someone from Islamabad in Punjab or Sindh. In Rawalpindi, a patwari from Chakwal is not appointed, nor is anyone from Rawalpindi posted in Jhelum. I don’t know what happens to you when it comes to Islamabad”.

The original advertisement had suggested that people across the country could apply for the positions and would be hired on a quota system.

Justice Kayani stated that everything was facilitated for the authorities. “Every case has a verdict. You took an oath not to act in bad faith. There is no penalty for a mistake, but these are local posts – how can candidates from all provinces be appointed? This court has several verdicts. The quota system is uniform throughout Pakistan”.

Judge Kayani added that dishonesty and misuse of tools is widespread, which is why local elections are not held. He remarked: “Now you have even established a constitutional court, but the work is still not done. Everything is in your favor. Judgments have been given on all cases. Do not act in bad faith. Mistakes are not punishable”.

After hearing a case of private persons performing official duties in Islamabad’s patwar circles, Justice Kayani criticized the administration for failing to publish a proper advertisement for the posts. “Does every task need to be completed only after a contempt case? The Deputy Commissioner convicted by this court was awarded a medal by the President”.

Justice Kayani warned: “If I issue a contempt, I will not act like Justice Babar Sattar and give time. I will handcuff you and send you to jail immediately. Your medals can stay here. You have set up a constitutional court but still no work is done”.

The judge ordered that a revised advertisement be issued before the next court hearing. The case was adjourned until next month.
