Islamabad High Court (IHC) has expressed its dissatisfaction with the federal government’s request to dispose of a petition seeking repatriation of Dr. Aafia Siddiqui, and asks how Pakistan hand over alleged terrorists to the United States in the absence of any extradition treaty.
When Justice Sardar Ejaz Ishaq Khan from IHC on Friday resumed to hear the petition about Dr. Aafia’s return, the federal government submitted a miscellaneous application requesting the immediate disposal of the case.
During the consultation, the extradition of ISIS commander Sharifullah, caught by Pakistan and handed over to the United States recently, was also mentioned.
Justice Khan, who turned to the extra legal lawyer, said the government claims that there is no prisoner exchange agreement with the United States, but Pakistan handed a detainee without any agreement.
“You even got the opportunity to inform the Court of Camera about the possibility of Dr. Shakil Afridi’s extradition to the United States [in return of Dr Aafia Siddiqui but that briefing never took place]”He said.
The court noted that two statements were submitted and the government’s response was considered unsatisfactory. Now the government is trying to dispose of Dr. Aafia’s Petition.
“Simply, you say you want to get rid of this case. The Prime Minister wrote a letter to the US president as needed, a visa was issued and what needed to be done. Such an approach will make the whole world aware of Pakistan’s attitude and efforts,” he said.
The judge noted that the lawyer for Pakistan’s office during the previous hearing had been required to give recommendations to the government and inform the court, but now the government asked that the case should be closed.
The court later issued a notice of the various application and postponed the hearing until Friday.
