Justice Jamal Khan Mandokhail has observed that the government should send all cases to military courts for assessment after declaring that the civilian system has collapsed.
Justice Mandokhail is part of a seven-member constitutional bench from the Supreme Court, which on Monday resumed to hear the intra-court appeals filed by the government against a previous order from the Point Court canceling trial against the 9th of May-Uptings in military courts.
General Attorney for Pakistan (AGP) Mansoor Awan began his arguments in support of the intra court appeals and noticed that giving the right to appeal to the people convicted by military courts is a political issue that he would submit submissions after receiving education from the government. Justice Mandokhail stated that parliament should investigate the political issues and that CB is only believed to be limited to the immediate case. “They should also make this political decision that the civil system has failed and that all cases should now be sent to the military court,” he said.
AGP Awan said he would present arguments on three points. “The Ministry of Defense, Khawaja Haris, has already provided arguments regarding the events on May 9, 2023.
The court postponed the hearing of the case until May 5.
