Tug of War at IHC intensifies

The traits of the war between the judges, recently transferred to or appointed by the capital’s Supreme Court and its ancient guards, continue as a division bench – led by justice Mohsin Akhtar Kayani – order a case of a case before a bench hearing it earlier. Following this order, however, Islamabad High Court (IHC) Registrar Office issued a new case list on the instruction of functioning Chief Justice Sardar Muhammad Sarfraz Dogar, without any case listed in Coming Before Justice Kayani, led Division Bench. A division bench consisting of Justice Kayani, also IHC’s senior Puisne judge, and Justice Sardar Ejaz Ishaq Khan heard an appeal against the order of responsibility in a case related to the abuse of land in Islamabad E-11 sector. At the last hearing of the case-April 28-, the case was postponed until May 22 due to non-accessibility of the bench. However, the ITHC registrar also issued a new duty list on April 28 on instruction from the functioning Chief Justice, after which the case was listed for a new bench consisting of Justice Kayani and Justice Saman Rafat Imtiaz. This new bench heard the case on Friday. According to a written order issued after the hearing, the bench was told that the case had already been heard by a bench consisting of Justice Kayani and Justice Khan. The bench therefore ordered the case before the original bench. After the order, a new judge’s duty list has been released. In the new watch list, the division bench led by Justice Kayani has been dissolved and is no longer included in next week’s list. One day earlier, during the hearing of a contempt case, Justice Sardar Ejaz Ishaq Khan had noticed that he could not pretend that there was no conflict among brothers in the capital’s Supreme Court.
