California files lawsuit against the Ministry of Justice after trans athlete demand

California filed a lawsuit against the Ministry of Justice on Monday after officials demanded that the State Public Gymnasiums confirm that they will prevent transient athletes from competing in girls’ sports.

The state said in its trial that the Ministry of Justice had “no right to make such a claim” and quoted “no authority that would allow them to issue or enforce the certification question” to each local educational agency.

California defended the laws that have come into doubt that allow athletes to participate in sports “in accordance with” their gender identity and does not violate the straight protection clause in the fourteenth change.

The trial said the State Statutes “not classify or discriminate based on ‘biological sex'[e] [cisgender] Female students with athletic opportunities and benefits on the basis of their gender, ‘and do not affect any differential treatment on the basis of sex.

“Instead of allowing athletic participation in accordance with student gender identity is essentially related to the important government interests by giving all students the benefits of an inclusive school environment, including participation in school sports, and preventing the serious injuries that transient students would suffer from a discriminatory, exclusive policy,” added trial.

The state requested an order from the demand letter.

Last week, assistant law lawyer resented Dhillon in a letter obtained by Pakinomist Digital said that public school districts must “written certify” before June 9 that they will not comply with California Interscholastic Federation’s gender identity rules.

“Consciously deprived of female students for athletic possibilities and benefits on the basis of their gender would constitute constitutional discrimination during the provision of gender equality,” Dhillon wrote in the letter.

California Interscholastic Federation controls public and private high school sports in the state and has a statute that requires its members to recognize gender identity in sports.

All students must be able to participate in school sports “in a way that is consistent with their gender identity, regardless of the gender listed on the student’s posts,” the statutes say.

Dhillon, a former California-based conservative lawyer, said the certifications she is looking for from the public school districts will “secure compliance” with section IX and help them “avoid legal responsibility.”

California’s Law Attorney Rob Bonta said in a statement that the trial was filed “in anticipation of impending legal retaliation against California’s school systems”, which did not meet Dhillon’s demand, according to the Los Angeles Times.

“The president and his administration require California’s school districts to break the law and violate the constitution – or face legal retaliation. They require our schools to discriminate against students in their care and deny their constitutionally protected rights,” Bonta wrote. “As we have proven time and time again in court just because the president disagrees with a law does not make it less of one.”

The Ministry of Justice had no immediate comment on the trial.

DOJ previously brought a lawsuit against Maine after the state repeatedly has his nose against President Donald Trump’s executive order to keep men out of girls and women’s sports.

The Ministry of Justice accused Maine of “Open and defiantly whistling federal law on discrimination by enforcing policies that require girls to compete against boys in athletic competitions who are exclusively appointed for girls.”

The latest chapter in California between the state and the Trump administration came days after the transking athlete AB Hernandez won the state championships in the girls’ branch.
