Five IHC referees challenge SC that controls court transfers, seniority

Five Judges in Islamabad High Court (IHC) have filed an intra-court appeal for the Supreme Court who contested the decision on legal transfers and seniority convicted in favor of the IHC by the Apex Court earlier, earlier, earlier Express news reported.

Through senior advisor Munir A Malik asked the five judges SC to cancel the decision made by a five-member bench that had maintained the transfer of judges within IHC.

The decision had also referred the issue of courtsy to the president of Pakistan.

They also requested SC to limit three transfer judges, including Justice Sarfraz Dogar, from performing any judicial and administrative functions such as IHC judges.

In their petition, the judges have sought an immediate suspension of SCS decision on June 19 until their legal appeal is heard.

In addition, they moved the right to introduce a residence order on the determination of seniority of judges transferred to IHC and prevented the president of Pakistan from making decisions in this regard.

The petition further calls for stop the legal commission’s steps to appoint Justice Sarfraz Dogar as the permanent head of the Islamabad High Court.

The Intra-Court Appeal, along with the request for a residence order, was filed before the Point Court after IHC found the transfer of judges and seniority issues disputed.

The legal struggle between the two judicial bodies has raised concerns about the process of legal appointments and seniority provision within Pakistan’s highest courts.
