A teenager in Pennsylvania had her trial of having to meet a trans athlete against her high school dismissed by a federal judge.
Quakertown Community High School Girls’ cross -country skiing and runner Aislin Magalengo sued the school and Pennsylvania Interscholastic Athletic Association (PIAA) earlier this year. The trial claims that Magalengo was done to compete against a trans student at Plymouth Whitemarsh High School at a cross -country meeting in September 2024.

Allen won first place at the meeting while Magalengo came in second place. The trial claims that Magalengo continued to compete against Allen throughout the season.
American Magistrate Judge Wendy Beetlestone rejected the case on August 1st. Betlestone was appointed by former President Barack Obama in November 2014.

“Her changed complaint is devoid of actual claims that she was subject to targeted discrimination, except to claim just as much in the most final way,” Judge Wendy Beetlestone wrote in her decision. “She points to no case that students who were awarded to women at birth are treated differently than those assigned to a man at birth, and as such she has failed to state a requirement for sex -based discrimination.”
Plaintiffs’ lawyer, Keith Altman, said they will appeal the decision.
“Of course, the client is disappointed and still strongly believes in what has happened,” said Altman pr. NBC Philadelphia. “We will continue to pursue the problem. We think it is an extremely important topic and it needs to be resolved.
“It is undeniable that men, as a general suggestion, are more physically skilled than women. We think it is fundamentally unfair that someone who simply says, ‘yes, I identify myself as a female’ is now able to compete with women and dominate women’s athletics. It just doesn’t make sense.”
