The Kern County Board of Education in California on Tuesday became the latest Blue State Board of Education, which adopted a local decision to keep biological men out of girls’ sports while its state legislation is doing the opposite.

The state has been a fireplace for controversy involving trans athletes competing in Women’s Gymnasium and University Sports in the last year and a top goal of President Donald Trump’s administration to tread his mandate to enforce title IX.

Kern County Board of Education President Mary Little told Pakinomist Digital that her board unanimous 6-0 decision was in response to Newsom’s “illegal” tross against federal law.

“We have talked about it on and off, especially since there has been a problem with how the head of government Newsom has reacted to the federal law,” Little said. “He does not follow the original intention of section IX … so these laws must trump the laws of California, and we must comply with them before we follow an illegal California law.”

Little said her school board has not received any pushback from the state government with regard to the new decision.

The Kern County Board of Education Trustee Lori Cisneros initially proposed the decision to the board. Cisneros has been a teacher 28 years old and works as an independent teacher who provides her services to charter schools.

“I think it is necessary to do our duty to protect girls in sports, and I look for their security and justice,” Cisneros told Pakinomist Digital. “I am not happy with the governor. He does not comply with federal law … and he is pushing intentionally to go against what title IX is about.

“I see it affecting families with girl athletes who are frustrated with having to compete against a biological man. And they are frustrated because biological men are obviously stronger, bigger and just different from how girls are designed.”

The US Department of Justice has brought a lawsuit against the California Department of Education (CDE) and California Interscholastic Federation (CIF) for its policies that continue to allow men to compete in girls sports throughout the state.

“(Newsom) costs taxpayers a lot of money by illegally warding off the law,” Little said.

Kern said that if she could send a message directly to Newsom, she would tell him, “Follow the federal law and section IX.”

Pakinomist Digital has reached the Newsom’s office for a response.

American Education Secretary Linda McMahon praised Kern’s recent decision in a x on Thursday.

“California’s Kern County Board of Education made a brave decision to defy their ruthless governor and take a stand for women and girls. I praise the board members and hope other counties follow and protect women’s sports,” McMahon wrote.

Several schools and families in California were influenced by events involving men competing in girls sports in the past school year alone. An incident that especially caught Little’s Eye was a situation at Martin Luther King High School in Riverside, California, where a trans-gender student took a varsity place from a female athlete on the girls’ cross-country skiing team in the fall.

The female athlete who lost her place, Taylor Starling, then brought a lawsuit against Riverside Unified School District.

“In my opinion, it was unfortunate,” Little said. “He is a biological man. He is not a woman. He runs against girls and it is fairly unfair.”

Little said she believes that parents have a “constitutional right” to prevent their daughters from competing against men in girls sports and suggested it is a “discriminatory practice to put trans athletes in girls sports and closet space.”

“It’s just a fundamental constitutional right for parents to have children in sports without their students being subjected to discriminatory practice,” Little said. “The males are men and females are females.

“There are biological differences. A man is able to do more, faster and stronger.”

Little said eight speakers attended Tuesday’s meeting to oppose the decision and support Trans -Intress in Girls Sports. Little said these speakers claimed the decision was “unfair.”

“That’s their opinion. I welcome everyone’s opinion and I want to listen to it and make sure I understand it,” Little said. “And if we disagree we disagree.”

Little also calls on other school boards to adopt their own decisions to comply with section IX.

“Absolute, why not?” She said when asked if she would encourage other California school boards to follow her lead. “Take a stand and protect the students, especially the girls in sports and other vulnerable areas such as changing rooms.”

Newsom has previously said that CDE and CIF follow laws that the state passed in 2013, but has repeatedly said he believes that men who compete in girls sports are “unfair.”

“I struggled with the question of justice when it came to sports,” Newsom said in response to the trial at a July event. “And we tried to find out a couple of years ago and we were not successful. And we recently struggled with it.

“And my attitude is that I don’t think it’s fair, but I also think it’s degrading to talk down to people and to break down the transfer community. And I don’t like the way the right wing talks about the trans community. These people just want to survive.”

ONE Bipartisan Survey By the Public Policy Institute of California, most of California residents found against biological male trans athletes competing in women’s sports.

This number included more than 70% of State school parents.

“Most Californians support that those who require transnry athletes compete for teams that matched the gender they were assigned at birth,” the vote states.

“Solid majorities in adults (65%) and probably voters (64%) support that requires transking athletes to compete on teams that match the gender they were assigned at birth, not the gender they identify with. An overwhelming majority of public school parents (71%) support such a requirement.”
