Carnival cruise line faces $5m lawsuit over passengers’ burnt feet on lido deck

Carnival Cruise Line is facing a major shipping lawsuit after a passenger’s claim of severe second-degree burns on his feet.

He sustained the injury while walking barefoot on the Lido Deck of the Carnival Magic.

The lawsuit was filed by Florida resident Jorge Luis Alverio Nunez in the Southern District of Florida on May 11, 2026, seeking damages in excess of $5 million. This happened more than a year ago, on May 21, 2025, when the ship sailed through the Caribbean.

The court documents revealed that Nunez walked around two steps from the pool area to a nearby lounge chair where his shoes were placed.

According to him, the deck surface was too hot for guests to walk barefoot as the temperature was more than 30°C (86°F) due to the strong sunlight in the Caribbean, causing burns that required medical treatment.

These injuries now cause him mobility problems and physical disfigurements.

Nunez says Carnival Cruise Lines is to blame for their negligence in failing to ensure safety on deck by providing cooling measures or by warning guests about it through proper signage.

In addition, it is mentioned in the complaint that there was no notice to the guests about wearing shoes.

Since Carnival usually recommends wearing sandals or water shoes for protection, the plaintiff claims this proves the company was aware of the risk.

The cruise line has remained silent on the ongoing lawsuit.

The lawsuit also refers to previous complaints made by passengers on social media regarding the hot decks, highlighting one instance where a below-the-knee amputation allegedly occurred. The ship, Carnival Magic, continues its Caribbean sailings out of Miami.
