The counsel for the appellants requests the court to grant them protection from CDA action
ISLAMABAD:
A division bench of the Islamabad High Court (IHC), comprising Justice Azam Khan and Justice Raja Inam Amin Minhas, on Monday issued a notice to the Capital Development Authority (CDA) regarding the internal appeal filed by the sub-leased holders of another 20 flats at One Constitution Avenue and sought its response.
During the hearing of the appeals of the 20 appellants within the court, including former Air Chief Mujahid Anwar Khan and former Pakistan Cricket Board Chairman Ehsan Mani, the appellants’ counsel, Barrister Ali Raza, said the appellants’ rights were affected by Section 30 of the IHC’s single judge decision.
He prayed the court to declare the rights acquired by the appellants under the sublease to be legal and effective. He further put forward the appellants’ claim, stating that the CDA should be prevented from interfering with the appellants’ peaceful possession of the flats and that section 30 of the single instance decision should be annulled.

Noting the importance of the current issue, the lawyer pointed out that a Prime Minister’s Committee had also been set up to investigate the One Constitution Avenue case. He also requested the court to timely issue an order for the protection of the flat owners before the committee can say that they cannot do anything on May 26, saying that the next day is Eid. He expressed the fear of the appellants that the CDA may come to their flats and ask them to vacate again.
In response, Justice Khan said they are issuing a notice and directed the CDA to submit a reply on Wednesday.
