The Scrutiny Committee has held that the power to remit cases to subordinate courts for a new hearing is an extraordinary and remedial jurisdiction which cannot be exercised routinely.
It said appellate courts are required to decide disputes themselves where the record is complete, rather than delaying trials for protracted litigation.
According to a detailed judgement, a two-member bench comprising CJP Yahya Afridi and Justice Shahid Bilal Hassan converted a petition filed by Muhammad Zubair into an appeal and allowed it in a family dispute involving khula, dowry, gold jewelery and child maintenance.
